Your use of this site, and any information, services or products made available through this site (collectively the “Services”) is subject to your agreement to the terms and conditions set forth herein. Use of this site is solely at iZen Bamboo's discretion, and iZen Bamboo reserves the right to prohibit anyone from accessing, browsing, supplying information to or downloading information from this site. You are not granted any rights in or to this site, any Services or any site related information, other than the limited right to use this site and the Services as we have authorized in accordance with the terms of this agreement and the policies and procedures that iZen Bamboo may adopt and make available from time to time. iZen Bamboo may terminate your access to this site at any time with or without cause.

Proprietary Information

This site contains information proprietary to iZen Bamboo and its business partners and customers (“Information”) including but not limited to (i) the site’s look, feel and embodied know-how, ideas, concepts and images and (ii) information and data related to iZen Bamboo, its business partners and its or their customers. You acknowledge that this Information may be treated as confidential by iZen Bamboo, its business partners and customers and agree to take all reasonable measures to protect the confidentiality of the Information. United States copyright laws and international treaties also protect this site. Any unauthorized use of the materials appearing on this site may violate copyright, trademark and other applicable laws and could result in criminal or civil penalties.

Our business partners or customers providing or using Information that is made available on this site, including yourself, are solely responsible for the accuracy and content of the Information supplied or used, and you agree not to supply any Information that infringes the intellectual property rights of any other party or that is misleading, fraudulent, defamatory, libelous, threatening, harassing, injurious to minors, pornographic, obscene or illegal. You agree (i) not to retransmit, publicly display, sell or use the Information provided for unauthorized business purposes and (ii) not to alter or remove any of the Information or any consent or other proprietary notice or legend on any of the Information, other than Information that you have supplied. You agree to comply with all applicable laws and regulations regarding your access to and use of the site and the Services.

Purchases

To the extent we offer any products or services for sale on the site and you wish to purchase such products or services, you will be asked for certain information in connection with your purchase, including, without limitation, credit card information. You agree to provide us with accurate, correct and up to date information, which we shall administer in accordance with our privacy policy. We may update our privacy policy and practices from time to time at our sole discretion.

If you make purchases on this site and pay by credit card, you grant to us permission to charge all fees incurred using the credit card you provide to us. If payment cannot be charged to your credit card or such payment is returned to us for any reason, we may either suspend or terminate your account and all services under this agreement and you will personally owe us any unpaid or owed balance. You will also be responsible for paying any applicable taxes relating to your purchases.

Site Errors

In the event a product is listed on the site at an incorrect price or with incorrect information, iZen Bamboo reserves the right to correct such information and price without liability and orders for such products will be revised to reflect the correct price or information. iZen Bamboo reserves the right to reject any orders placed on the site with or without cause.

Limited Warranty

iZen Bamboo warrants to the original purchaser that products sold from this site shall be free from defects in material and workmanship for a warranty period of one (1) year from purchase. If buyer claims that a product violates such warranty, iZen Bamboo, upon notice, will issue shipping instructions to buyer for return to iZen Bamboo at buyer’s expense.  Except where prohibited by applicable law, this warranty is nontransferable and is limited to the original purchaser. This warranty gives you specific legal rights, and you may also have other rights that vary under local laws.

Remedies:  iZen Bamboo’s entire liability and your exclusive remedy for any breach of warranty shall be, at iZen Bamboo’s option, (1) to repair or replace the hardware, or (2) to refund the price paid, provided that the hardware is returned to the point of purchase or such other place as iZen Bamboo may direct with a copy of the sales receipt or dated itemized receipt. Shipping and handling charges may apply except where prohibited by applicable law. iZen Bamboo may, at its option, use new or refurbished or used parts in good working condition to repair or replace any hardware product. Any replacement hardware product will be warranted for the remainder of the original warranty period or thirty (30) days, whichever is longer or for any additional period of time that may be applicable in your jurisdiction.
This warranty does not cover problems or damage resulting from (1) accident, abuse, misapplication, or any unauthorized repair, modification or disassembly; (2) improper operation or maintenance, usage not in accordance with product instructions or connection to improper voltage supply; or (3) use of consumables, such as replacement batteries, not supplied by iZen Bamboo except where such restriction is prohibited by applicable law.

How to Obtain Warranty Support:  Before submitting a warranty claim, we recommend you visit our user manual page or contact our technical support department for assistance. Valid warranty claims are generally processed through the point of purchase during the first thirty (30) days after purchase; however, this period of time may vary depending on where you purchased your product – please check with iZen Bamboo or the retailer where you purchased your product for details. Warranty claims that cannot be processed through the point of purchase and any other product related questions should be addressed directly to iZen Bamboo. Limitation of Liability:  You assume full responsibility and all risk of loss resulting from your use of this site and any information or products sold on this site or received by you from your use of this site. Under no circumstances shall we, or any of our employees, affiliates, subsidiaries, suppliers, distributors, licensees, agents or representatives be liable for any indirect, incidental, consequential, special, exemplary, punitive or other damages, arising out of or relating in any way to this site and/or any materials contained on this site, any linked site or any product or service purchased through this site. Our total liability shall be limited to any amount paid by you to use this site or for the cost of products purchased by you from this site, and you hereby release us and our employees, affiliates, subsidiaries, suppliers, distributors, licensees, agents and representatives from any and all suits, obligations, damages, liabilities and claims, known or unknown, in excess of such limitation.

Duration of Implied Warranties:  Except to the extent prohibited by applicable law, any implied warranty of condition of merchantability for a particular purpose on this hardware product is limited in duration to the duration of the applicable limited warranty period for your product. Some jurisdictions do not allow limitations on how long an implied warranty lasts, so the above limitation may not apply to you.

National Statutory Rights:  Consumers have legal rights under applicable national legislation governing the sale of consumer goods.  Such rights are not affected by the warranties in this Limited Warranty.

No Other Warranties:  No iZen Bamboo dealer, agent, or employee is authorized to make any modification, extension, or addition to this warranty.

Warranty Periods:  Please note that in the European Union, any warranty period less than two years shall be increased to two years.

Privacy Policy

This “Privacy Policy” is designed to notify you about how we collect, use, disclose, transfer, and otherwise process personally identifiable information that we collect on the site (“Personal Information”). Each time you visit the site, you consent to the collection, use, disclosure, and processing of Personal Information in accordance with this Privacy Policy. In particular, if you are located in a jurisdiction outside the United States, you consent to the transfer of your Personal Information to our servers and computer systems anywhere in the world, including to countries that may not provide an equivalent level of data protection to the laws in your home jurisdiction.
